You were injured because a driver was careless.
Maybe you were injured because a doctor violated the basic standards of medical care.
Maybe your spouse died because the pharmacy dispensed the wrong medication.

In each of these cases, the victim will have suffered some type of pain for a certain period of time.

When you bring a lawsuit in New York seeking compensation for those harms and losses you suffered because of someone else’s carelessness or negligence, you will also include a claim for pain and suffering.

At trial, we must distinguish the pain and the suffering you endured from the time of the wrongdoing until the time of trial.

That could be a few years.

Then, depending upon your injury, you may have a permanent ongoing pain and disability that limits you or prevents you from doing your daily activities.

Maybe your pain prevents you from doing those activities that you used to be able to do without any problem.

Anything that is going to affect you from the time of trial into the forseeable future has to be explained to the jury.

The jury needs to know if you’re in pain now.
The jury needs to know how your pain will affect you on a daily basis.

If the jury finds in your favor, they will be required to compensate you not only for your suffering and pain you went through up until trial, but also into the future.

That’s why they need to know if you’re in pain now.
