Most injured victims of medical malpractice want to wait before deciding to take legal action.
They want their injuries to heal first.
They want to return to work first.
They want their doctor to apologize to them first before taking action.
These ‘excuses’ do nothing to advance your matter and determine if you even have a valid basis to bring a lawsuit here in NY.
In fact, the only thing those excuses do for you is extended time in which you are trying to make a decision about what you should do next.
The problem with waiting for those things to happen is that by the time you finally make a decision to proceed forward with a lawsuit against a doctor or hospital who violated the basic standards of medical care is that you run the real risk that the time in which you have to file a lawsuit against those wrongdoers has expired.
In New York you have a very specific time period within which to file a lawsuit on your behalf. If that time has lapsed, there is nothing you will be able to do to fix that problem.
You should keep in mind that there are different time limits for different types of hospitals as well as different age groups of people who suffer injury at the hands of careless doctors and hospital staff.
What this means for you is that while your reasons for wanting to delay evaluating a possible medical malpractice case may make good sense to you, from a legal standpoint your clock is ticking. You do not want the clock to run out while you are waiting.
In addition, one of the other advantages to acting immediately is that your memory is still fresh. The longer you wait, the greater chances that your memory of the specific events will fade and you will be unable to recall many of the details that you know right now.
