It’s a medical malpractice lawsuit.
You believe your doctor violated the basic standards of medical care.
You believe that a doctor’s negligence or carelessness caused you harm and the defense refuses to settle.
Your case proceeds to trial. During the course of your trial, you look around and notice that the doctor you sued is nowhere to be found.
You notice this on the first day.
You notice this again on the second day.
Finally, you turn to your attorney and ask “Where is the doctor that I have sued? Why isn’t he in court every day like I am?”
Your attorney tells you that the doctor cannot be in court each and every day.
He’s still practicing medicine.
The doctor sees patients each and every day.
You learn that the doctor’s attorney has told the jury that he will not be in court each day.
During opening arguments you learn from the defense lawyer that the doctor cannot be in court each and every day.
You also learn that during jury selection the defense attorney told these jurors that the doctor would not be able to come into court each and every day. He also asked the potential jurors whether they would hold it against him and his client if he was not in court each day.
